In a recent interview, King discussed how parents' misapprehensions about the divorce process and child custody issues can cause them to mistakenly believe that they are doing what’s best for their children's future.
For example, some warring spouses think that their children will be best served by fighting all the way to the courthouse, and having a judge decide who gets the kid for how much time, etc. According to King, a long, drawn out divorce battle “takes big emotional toll on children, who often pick up on their parents’ anxiety and anger during the process.”
King also noted that it is usually much better (and certainly less expensive) if parents can reach agreement between themselves about child custody issues rather than leaving the fate of their children to “someone in a black robe.” He strongly urges that couples try to reach common ground on custody issues and seek agreements for the children’s benefit as they grow rather than turning control over such matters to a judge.
King said: "Children will get through a divorce between parents if they know they are handling matters in an adult, calm manner. If a relationship is amicable, couples work out the issues together." Another misconception is that the mother will always be awarded child custody. "This may have been the norm 20 years ago, but today's society has changed dramatically," King said. "Divorce courts assess each case on its own merits, on the facts, and at all times, in a child’s best interests. In Tennessee, the law is now gender neutral, and there are quite a few cases in which the father is designated the Primary Residential Parent, or in which the partie receive equal parenting time.”
He added: "Family dynamics have drastically changed, so a court will factor in many things, such as the parent who is more available to look after the children, and how each parent can support and encourage the relationship between the children and the other parent.."
King also revealed that one parent would not necessarily receive financial support from the other in a shared custody arrangement if their earnings are relatively equal. However, even in a shared custody arrangement, if one parent earns substantially more, they should expect to pay child support to the other parent. The "50/50 custody means no child support" belief is a myth.
Another misnomer is that a child aged 12 or older gets to choose where they can live, he said. "A child can voice their reasoning through several legal channels, and a court will hear those desires. But, it is the court that will rule on this matter, and there are many other relevant factors to consider." However, when a child reaches 18 years, they are considered an adult, and a court cannot grant legal custody to one parent over another.
"Ultimately, when it comes to children, divorcing parents are highly advised to seek legal help. The overriding factor is that a child’s best interests are to be served at all times," King concluded.
