Sauchik & Giyaur, P.C. – MDRXLaw is proud to announce an unprecedented arbitration victory on behalf of a New Jersey pharmacy group, successfully recovering over $7 million in withheld payments from a major Pharmacy Benefit Manager (PBM).
The arbitration, which culminated in multiple days of testimony of fact and expert witnesses, resulted in a complete victory for the pharmacy. Throughout the arbitration, the firm employed innovative legal strategies that ultimately proved entirely successful. The case involved complex issues spanning federal and state laws and regulations, including the Federal Food, Drug, and Cosmetic Act and Kefauver-Harris Amendments of 1962, as well as nuanced aspects of pharmacy practice.
The ruling not only restored all withheld funds but also awarded interest, attorneys’ fees, and costs exceeding $1.7 million, ensuring full compensation for the client. The PBM has not challenged the final arbitration award and promptly remitted the funds.
“This decision reinforces the importance of holding PBMs accountable and protecting the rights of independent pharmacies,” said Alec Sauchik and Kristina Giyaur, lead counsel on the case. “We are thrilled to have delivered justice for our client and will continue advocating for fairness in pharmacy reimbursements.”
MDRXLaw remains at the forefront of pharmacy litigation and arbitration, fighting for fair treatment in an evolving healthcare landscape.
