Ontario's $50,000 Small Claims Court Era Opens New Doors for Consumers and Small Businesses

Ontario residents and small businesses can now pursue civil disputes valued at up to $50,000 in Small Claims Court, opening the door to a broader range of claims in what is commonly known as the "People's Court."

The monetary limit increased from $35,000 to $50,000 on October 1, 2025. The minimum amount required for an appeal also increased from $3,500 to $5,000.

The higher limit means that many disputes that previously exceeded the Small Claims Court's jurisdiction can now be addressed through its comparatively streamlined process.

"A higher dollar ceiling does not make every case simple," said Mohamed, a licensed Ontario paralegal with My Paralegal. "A $40,000 or $50,000 dispute can involve complicated contracts, conflicting evidence, multiple witnesses and serious financial consequences. Preparation still determines the strength of the case."

More Disputes Now Qualify

Ontario's Small Claims Court can hear claims seeking money or the return of personal property valued at $50,000 or less, excluding interest and costs.

Common disputes can include:

  • Unpaid invoices and business debts.
  • Breach-of-contract claims.
  • Defective construction or renovation work.
  • Property damage.
  • Unpaid loans.
  • Consumer disputes involving faulty goods or services.
  • Employment-related monetary claims within the court's jurisdiction.
  • Claims involving the return of personal property.

The expanded jurisdiction may be particularly significant for contractors, tradespeople, consultants, landlords, consumers and small-business owners who previously faced the choice of abandoning part of a claim or pursuing a more complex Superior Court proceeding.

Digital Filing Does Not Replace Legal Preparation

Although many Small Claims Court documents can be filed online, completing an electronic form is only one step in the litigation process.

A claimant must still identify the proper defendant, explain the legal basis of the claim, calculate the damages, organize supporting evidence, serve the documents correctly and comply with applicable deadlines.

"A court portal can accept a document, but it cannot tell someone whether they have sued the correct party or properly pleaded their case," Mohamed explained. "Those details can make the difference between an enforceable judgment and an expensive disappointment."

Defendants must also take claims seriously. Failing to deliver a defence within the required time can expose a defendant to default proceedings and a judgment without a trial.

Winning and Collecting Are Different Battles

My Paralegal also cautions that obtaining a judgment does not automatically produce payment. Successful parties may still need to consider enforcement measures such as garnishment, a writ of seizure and sale or an examination hearing.

Before starting a claim, parties should consider:

  • Whether the defendant can be correctly identified and located.
  • Whether sufficient documents and admissible evidence are available.
  • Whether a limitation deadline may affect the claim.
  • Whether the defendant has income or assets against which a judgment could be enforced.
  • Whether early negotiation or settlement may produce a faster and more economical result.
